Affidavit signing - 3/11

FRRACS is seeking affidavits for our newest appeal in the Chapter 91 Waterways case.

On Wednesday, March 1, FRRACS' attorney Michael Hayden filed the paperwork before the Office of Appeals and Dispute Resolution (OADR) with the Mass Department of Environmental Protection (DEP) for an appeal, yet again, in the Chapter 91 Waterways case. The DEP has chosen to ignore not only Adjudicator Jane Rothchild but the Superior Court of the Commonwealth, and in a unilateral decision by Adjudicator Salvatore Giorlandino--who claims to have been given authority--the Waterways permit was given back to Enbridge with no explanation. 

We need your help with this appeal. Did you use the Kings Cove Park, beach areas, and waterways to recreate, bird watch, fish, or even walk your dog prior to the construction of the Weymouth compressor station? Have you stopped using this area due to the threats (toxic emissions, noise, explosive potential) posed by the compressor station?  If you have, this violates the mandate of the Office of Coastal Zone Management to provide access to our coastal waterways to all residents. 

On Saturday, March 11th from 10:00 AM to 1:00 PM and on Wednesday March 15th from 6:30 to 8:30 PM, we will be at the Fore River Clubhouse, 16 Nevada Road, Quincy to collect affidavits from those of you who used to recreate at Kings Cove and no longer do so. A few things to keep in mind:

  • We will need your testimony as to how you once recreated in that area--a short written statement as to what you did but no longer do.  We will provide the form.

  • We will need to have your signature notarized. Our man Jerry will be there to do this, but we will need your drivers license or state issued ID at the time of the notarization.

  • These affidavits will be filed with our brief due on March 31 with the OADR. 

  • When the appeal is scheduled, we will need you to be available to testify in support of your affidavit in person.  Attorney Hayden will be available to instruct you through the process. (It's not as scary as it sounds!)
